1. GENERAL
1.1. These Sales Terms constitute a legally binding contract between yourself and Jam's Graphics ("we or us") and apply to the ordering, purchase, fulfilment and delivery of Goods from www.jamsgraphics.co.nz (the "Website"). By placing an order for Goods from our Website, you agree to be bound by these Sales Terms, our Website Terms of Use, and our Privacy Policy. In the event of inconsistency between the Sales Terms, Website Terms of Use and Privacy Policy, the Sales Terms shall prevail.
1.2. In these terms: (a) "Goods" refers to goods and/or services supplied, or to be supplied, by us to you as described in an Order which will be deemed to form part of these Sales Terms; (b) "CGA" refers to the Consumer Guarantees Act 1993; (c) "FTA" refers to the Fair Trading Act 1986; (d) "GST" refers to goods and services tax under the Goods and Services Tax Act 1985;
1.3. We reserve the right to revise these Sales Terms from time to time at our discretion. Such revisions will be effective immediately upon publication on the Website.
1.4. We recommend you review these Sales Terms each time you use the Website and before placing any Order. By continuing to use the Website following any amendment to the Sales Terms, you are agreeing to be bound by the same.
2. LEGAL CAPACITY
2.1. If you are under the age of eighteen (18), we recommend that you use this Website and make any purchases with the guidance or supervision of a parent or guardian.
2.2. By placing an Order, you acknowledge that you either: (a) are over the age of eighteen (18); or (b) have obtained the guidance or consent of a parent or guardian to complete the purchase.
2.3. These Sales Terms form a legal agreement, and we encourage all customers under 18 to ensure they understand the terms with the support of a responsible adult.
3. PRICING
3.1. The prices of Goods displayed on our Website: (a) are in New Zealand Dollars and include GST, unless otherwise specified; (b) exclude freight and handling charges, which will be added to the total Order Price; and (c) may change from time to time.
4. PRODUCT DESCRIPTIONS
4.1. We update our Website regularly and use reasonable endeavours to ensure that all information is current and correct; however, some variations may occur. Descriptions, illustrations, or other material provided are approximations and are intended to provide general guidance.
4.2. We reserve the right to correct any errors published on the Website.
4.3. It is important you check the Goods on arrival prior to use. We are unable to refund you for any defects detected after the item has been used or altered.
5. PLACING YOUR ORDER
5.1. Customer purchasing details and payment confirmation is required when submitting an Order through our Website.
5.2. By placing an Order, you make an offer to purchase the Goods you have selected based on these Sales Terms.
5.3. We do not formally accept your offer until your Order has passed our internal validation procedures and the availability of the Goods is confirmed.
6. PAYMENT METHODS
6.1. Payment may be made by credit/debit card, bank transfer or any other agreed method of payment.
6.2. By providing your payment details, you authorise us to deduct the Order Price.
6.3. All credit card transactions are processed securely.
6.4. To the extent permitted by law, we are not responsible for damages or losses suffered as a result of unauthorised use of payment details.
7. DELIVERY, RISK AND TITLE
7.1. Delivery costs are calculated at checkout and may be subject to revision based on location and item size/weight. Any updates to delivery charges will be communicated prior to shipping.
7.2. Risk in Goods passes to you upon delivery. Title remains with us until full payment is received.
7.3. We will not be liable for delays caused by events beyond our reasonable control.
7.4. It is your responsibility to ensure access to your property for delivery. Additional charges may apply if redelivery is required.
7.5. If Goods are requested to be left without signature, you accept full responsibility for any resulting damage or loss.
8. RETURNS AND REFUNDS
8.1. Goods may be eligible for return or refund if: (a) unused; (b) in original condition and packaging; and (c) returned within 10 days of delivery.
8.2. Goods not meeting these conditions may not be accepted for return. Restocking and freight fees may apply.
8.3. Return shipping is at your cost unless the return is due to our error.
8.4. Refunds will be processed within 10 working days of approval.
9. WARRANTIES AND CONSUMER GUARANTEES
9.1. Goods supplied are subject to New Zealand Consumer Law, including the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.
10. LIMITATION OF LIABILITY
10.1. To the extent permitted by law, our liability is limited to the replacement or repair of Goods or the refund of the Order Price.
10.2. We are not responsible for loss or damage resulting from misuse of Goods.
11. PRIVACY
11.1. We collect and use your personal information in accordance with our Privacy Policy available on our Website.
11.2. You are responsible for maintaining the confidentiality of your account login details.
